*Law 17/2012, of December 27, on the General State Budget for the year 2013, modifies in Article 68, effective from January 1, 2013, and with indefinite validity, paragraph 12 of section one of Article 20 of Law 37/1992, of December 28, on VAT, by which the fees set in the statutes of business organizations are exempt from VAT.

**Company classification

The associated fee is established according to the Statutes approved at the General Assembly. Full members are classified by company size, as recommended by the Commission of the European Communities of 6/5/2003 (OJ L 124 of 20/5/2003), in effect since 1/1/2005, which, among other things (without excluding other provisions of the recommendation*), defines:

• Microenterprise (1,200€): A company that employs fewer than 10 people and whose annual turnover or balance sheet total does not exceed 2 million euros.
• SME (1,800€): A company that employs fewer than 250 people and whose annual turnover does not exceed 50 million euros or whose balance sheet total does not exceed 43 million euros.
• Large enterprise (3,000€): A company that does not meet any of the above conditions.

(*) The definitions of Micro, SME, and Large enterprise reflected here are not the only criteria. In any case, the remaining requirements of the recommendation must be considered.

Right to request access to personal data concerning the data subject

You have the right to be informed of the following:

Right to request rectification

  • The data subject has exercised their right to object to the processing of data, while it is being verified whether the legitimate reasons of the controller prevail over those of the data subject.
• Request that the controller retain your personal data when:
  • The processing of data is unlawful and the data subject opposes the erasure of their data and requests the restriction of its use instead.
  • The controller no longer needs the data for the purposes of processing, but the data subject needs it for the establishment, exercise, or defense of legal claims.

Right not to be subject to individualized decisions

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or significantly affects you.

Se exceptúa lo anterior cuando:

• It is necessary for the conclusion or performance of a contract.
• Permitted by EU or Member State law, with appropriate measures to safeguard the rights and freedoms of the data subject.
• There is explicit consent from the data subject.

Right to withdraw consent

The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Before giving consent, the data subject shall be informed of this.

Right to lodge a complaint with the Supervisory Authority

Any interested party may lodge a complaint with the supervisory authority of any EU Member State if they consider that the processing of their personal data does not comply with the provisions of the Regulation.
